I represented Mr. Finley at his trial where he was accused of a felon in constructive possession of a firearm. At the trial I cross-examined the State of Florida's witnesses and laid the foundation fo ... r Mr. Finley's appeal. Unfortunately, Mr. Finley was convicted. On appeal Mr. Finley's conviction was reversed, and the appellate court the trial judge should have granted my Judgment of Acquittal. My Judgment of Acquittal centered around the State's lack of direct evidence tieng Mr. Finley to the firearm. The Fourth District Court of Appeals recognized there was a reasonable hypothesis of innocence that DNA on a gun found on a bed without the suspect in proximity to the weapon could have been transferred to by other means. My cross-examination laid the foundation for Mr. Finley's appeal. Here is a link to the decision:
