Client had been subjected to a forced abortion in China due to her violation of the country's Family Planning policy. She is now over the child bearing age and he had a criminal citation in the United ... States, but our arguments, evidence, and compelling testimony (achieved through several long prep sessions in my office) carried the day. The government opposed, stating that since she is not of child bearing age, there is nothing that the Chinese government will do to her now. While this point may be conceded, we argued that under the statute, it is not required to show the possibility of future persecution and that a finding of past persecution is sufficient under the Act to qualify as a refugee. The Court agreed and client's application was granted.

Chinese Religious Asylum with accusations of fraud

Client had been persecuted in China based on religion and filed an application for asylum through the help of a translator. Unbeknownst to client, that translator associate herself with an attorney tha ... t was later convicted of immigration fraud and that attorney was the one that actually signed the application even though client had never met him nor knew of the representation. Years later, the client's case is in immigration court and he hired our office to assist him. Prior to the final hearing, the government sent us an onerous package detailing why they believed his application was likely fraudulent due to his association with the convicted attorney during the preparation of the original asylum application. Our firm compiled a detailed Memorandum of Law with compelling Exhibits to refute this argument and to show that these accusations were unfounded and that he had met his burden of showing Past Persecution as well as a Well Founded Fear of Future Persecution based on his continuous practice of his religion. The immigration judge agreed with our arguments and granted his application.

Client previously entered the United States as an Amerasian refugee from Vietnam. Because of a recent criminal conviction, client was placed in removal proceedings. During the asylum hearing, client re ... counted extremely painful memories of growing up in Vietnam as a mixed race Amerasian. The immigration judge granted client's application to remain in the United States, finding that the harm he suffered in Vietnam was indeed great and that he would continue to be persecuted. However, the government appealed the matter. Alexandre Law Firm filed a vigorous response and the Board of Immigration Appeals dismissed the matter. Client was released in time to spend Christmas with his family!

Client had been placed in removal proceeding following a violation of probation which resulted in a sentence of one year. This new sentence placed his prior conviction into the Aggravated Felony catego ... ry and client was soon placed in removal proceedings by DHS. After an unsuccessful but necessary case for asylum and subsequent appeals, our office was able to convince the prosecutor in the criminal case to amend the sentence, nunc pro tunc, to 364 days. This eliminated the Aggravated Felony and made client eligible for Cancelation of Removal. Our firm succeeded in convincing the immigration judge that the client's equities outweighed the harm brought by his criminal record.

Client was convicted of Fraud related crimes and was placed in immigration removal proceedings following release from criminal custody. During the hearing, our team prepped and presented key witnesses, ... including the client's pastor, to prove that he was a devout Christian. The packets and briefs compiled by our firm clearly showed the atrocities suffered in China by loyal Christians and our brief successfully argued that the types of fraud related crimes were simply extraneous to the inquiry of whether persecution was likely. Although the immigration judge frowned upon the facts of the case, he concluded that he simply could not ignore the evidence in this case and granted Withholding of Removal to client

Client had previously illegally entered the country and was thus automatically held to the higher standard of Withholding of Removal. His family in Honduras had been brutally murdered by police officer ... s and gang members with strong ties to the police. Although the acts were brutal, the issue was proving a well-founded fear of persecution based on a cognizable ground. Our firm was able to successfully argue that being a family member of those slaughtered constituted membership in a particular social group for which client would also suffer deadly reprisals.

Client was placed in removal proceedings following a Burglary conviction. At the immigration hearing, we were able to convince the judge that "Mexicans with significant cultural and family ties to the ... United States" constituted a Particular Social Group. However, the judge denied the application based on discretion due to the Burglary conviction. We appealed the case to the Board of Immigration Appeals and the Board agreed with us that an adverse discretionary finding needs to consider the harm brought upon by the conviction versus the possibility of persecution. On remand, the immigration judge listed to testimony about the facts underlying the non-violent conviction and concluded that it was not severe enough to deny the application of asylum.
