Chinese forced abortion Asylum Claim

Client had been subjected to a forced abortion in China due to her violation of the country's Family Planning policy. She is now over the child bearing age and he had a criminal citation in the United ... States, but our arguments, evidence, and compelling testimony (achieved through several long prep sessions in my office) carried the day. The government opposed, stating that since she is not of child bearing age, there is nothing that the Chinese government will do to her now. While this point may be conceded, we argued that under the statute, it is not required to show the possibility of future persecution and that a finding of past persecution is sufficient under the Act to qualify as a refugee. The Court agreed and client's application was granted.
