Dec 24, 2014OUTCOME:
Debtor objected to the amount of the Chapter 7 Trustee's Commission because the Chapter 7 Trustee had used all money paid to litigation counsel in calculating his commission. The debtor also objected ... to various claims filed in his case on the basis that the third parties filing the claims did not substantiate their ownership of the debt. The Chapter 7 Trustee argued that the debtor did not have standing to raise these issues. The Trustee also argued that the commission should be allowed in its entirety and that the claims should all be allowed. The court found that the client did have standing. The court also reduced the Trustee's commission based on the settlement previously approved in the case and disallowed several of the claims which were filed in the case for lack of supporting documentation. This resulted in less money being paid to the Trustee and to creditors.
