The current Ohio Work Comp (BWC) system puts all the responsibility to pursue benefits onto the injured worker. This system is VERY confusing and full of rules and laws only a few would know what documents and forms to file and when to file. Only a few would know the requirements to establish a claim. Few know all injured workers' are ENTITLED to some form of compensation, and less would know how to maximize those benefits and obtain approval for treatment.
The system, as established, is inherently unfair and is currently set up AGAINST ALL injured workers.
For example; most employers in the State have Third Party Administrators (TPA's) These are large companies that are hired by employers to CONTROL COSTS on work comp claims filed against employers. Their SOLE purpose is to REDUCE expenses of work comp claims. Costs are controlled by denying claims, fighting claims OR keeping MEDCAl EXPENSES DOWN.
Furthermore, ALL employers are represented by MCOs ( Managed Care Organizations) These are large companies that MANAGE or CONTROL THE COSTS OF MEDICAL TREATMENT. Costs are controlled by DENYING any requested treatment.
What INJURED WORKERS DO NOT know the MCO's ONLY have the FIRST WORD on Treatment. NEVER THE LAST WORD. All MCO decisions ARE APPEALABLE! AND EVERY DENIAL OF TREATMENT SHOULD BE APPEALED!.
The BWC has ATTORNEYS ON STAFF; THEY WILL COME INTO HEARINGS ( where disputes are resolved) AND WILL ONLY ARGUE AGAINST THE INJURED WORKER!!!!! NEVER EVER WILL THEY ARGUE IN SUPPORT of an INJURED WORKER, even if the BWC supports an issue in favor of the worker, THE BWC ATTORNEYS WILL NOT ARGUE IN SUPPORT of an INJURED WORKER! I believe THIS PRACTICE IS UNCONSTITUTIONAL and WRONG!!!
