I recently litigated a jury trial in Montgomery County, Ohio. Our client was charged with Felonious Assault, a felony of the second degree, a charge that carries up to eight years in prison. He was int ... ially charged after allegedly getting into a fight outside of an apartment building around midnight. After two days of testimony, including multiple prosecution and defense witnesses, the case concluded with powerful closing arguments. After just two hours of deliberations, the jury returned a “not-guilty verdict,” which was extremely well received by our client. While all acquittals are rewarding, this one was particularly so, as our client had a number of friends and family members who questioned his innocence.

I recently wrapped up lengthy litigation in an extremely challenging child custody case. I represented the father of two teenagers who was involved in a long-term live in relationship with the children ... ’s mother. In October of 2012, one day he left the home to go to work, and when he came home, Mother and kids were gone. After frantically calling local police agencies and hospitals, he learned she moved to California and took the kids with her. We immediately filed custody complaints in the local courts and asked the court to retain jurisdiction even though the kids were now living in another state. The court agreed with us, appointed a guardian ad litem for the children and set the case for multiple hearings. Ultimately, one year later my client was awarded full custody and the mother was ordered to bring the children back to Ohio.

OUTCOME: Case Dismissed through Diversion/ILC. The prosecutor eventually agreed to reduce the charge and give the client a diversion program. After approximately six months, the case will be dismissed and she will have a clean criminal record.

I recently represented a local University of Dayton student who had a little too much fun on her first weekend back from summer break. She ended up getting extremely intoxicated and found herself passe ... d out near one of the university buildings on campus. Eventually, in the following early morning hours, the police apprehended the client. Unfortunately, she then got into a minor physical altercation with the police and then spent the night in the Montgomery County Jail. The prosecutor/police filed many charges against her, the most serious of which was Assault on a Police Officer, a felony of the fourth degree. That charge carries a potential penalty of 18 months in prison and a $5000 fine.

OUTCOME: Dismissal of felony charge. Defendant admitted to misdemeanor theft. He will serve a period of non-reporting probation and community service. Six months from now, we will expunge the case and the youth will again have a clean record.

I recently represented a juvenile client in Greene County Juvenile Court on a burglary charge, a felony of the second degree (the charge is similar to what he would be facing if he shot someone with a ... gun, a felonious assault, also a felony of the second degree). If adjudicated/convicted on the charge, he could have been sent to DYS until his 21st birthday. The incident arose after our client used the garage code to gain entrance into a buddy’s home and took some of the property inside. While the incident seems fairly innocent, the homeowners were extremely upset about the incident and pressed charges. This was our client’s first offense and he is generally a good kid. He is an honor roll student and he plays multiple sports for Fairborn High School.

OUTCOME: Dismissal of felony charge. The case was reduced to a couple of misdemeanors that were NOT sexual in nature. As a result, my client walked away from the case with no incarceration at all, and a period of probation that will likely only last six months.

My client is a juvenile attending a local suburban high school, located south of Dayton, Ohio. This past summer, he was accused of Gross Sexual Imposition and Abduction of a teenage girl outside of a ... local shopping mall. If adjudicated on the aforementioned felony charges, my client faced the possibility of spending time at DYS (juvenile prison) until his 21st birthday and being forced to register as a sexual offender for 15 years. The case was prosecuted in Montgomery County Juvenile Court, located in Dayton, Ohio.

No prison time for serious felony charge

OUTCOME: No prison time. I was able to work the case out with the prosecutor to the client’s satisfaction. While my client had to admit to a low level felony, he got most of the charges dismissed and avoided prison altogether.

My client is a distributor of tobacco and other products that are sold at convenience stores and gas stations. He operates a legitimate business that is incorporated and files annual tax returns. One o ... f his biggest products was spice/k2, also known as a synthetic drug. Unfortunately for the client, the law in the state of Ohio changed in the last few years, making spice/k2 illegal. Not only is it illegal but it can carry a mandatory prison term. In this case the client was charged with many counts of drug possession and trafficking and he was facing the possibility of being labeled a major drug offender. And he wasn’t even aware that the product was illegal. The case was prosecuted in Warren County Common Pleas Court, in Lebanon, Ohio, a suburb of Cincinnati.

OUTCOME: Dismissal. After extensive discussions with the prosecutor, she agreed to dismiss the case a few days before trial so long as my client would complete a diversion program.

My client is a graduate student who was charged with violation of a protection order in Warren County Court, located in Lebanon, Ohio, a suburb of Cincinnati. If convicted, he faced up to 6 months in j ... ail and $1000 in fines. The prosecutor in the case refused to make any offers, so I set it for a jury trial. I was able to locate a number of witnesses who were favorable to our case so I met with them a few times in preparing for trial. In the end, the case was likely to be decided by one particular witness who refused to talk to me.

OUTCOME: Case Dismissed

I recently represented a client who was charged with felony assault in a Greene County Common Pleas Court. If convicted, he faced up to eight years in prison for his offense and $15,000 in fines. This ... could have radically altered his life and damaged his reputation. Our client was charged with his crime after he became involved in a fight at a college bar in Fairborn, Ohio. He claimed that he acted out of self-defense but the court was skeptical. Some even alleged that he started the fight in the first place. Thankfully, I was able to produce a valid argument complete with convincing evidence that proved that our client was not guilty of assault. Instead, the prosecution eventually agreed that our client was defending himself against the alleged victim, who was actually the perpetrator of the crime. The case was dismissed a day before the trial was supposed to begin. Our client was extremely happy with the results. Because the case never went to trial, he was able to save time and money.
