Unfortunately you are at fault. The amount of damages may be apportioned to the other driver due to their behavior in operating their car.

Definitely you can file suit in small claims. Lack of insurance is not relevant to fault issues.

Do not sweat it. They will only sample for more if directed to do so. Even if they do test it, the probation officer is likely to use it as a base....

Any provision can be negotiated. However, what you have is standard for the insurance. Some carriers are easier than others in negotiating terms.
