Breach of Contract
May 01, 2018OUTCOME: Settlement in the full amount my client sought
In this case my client performed work for the opposing party. The opposing party and my client were friends when the working relationship started. So, as is usual between friends/new business partners, ... the two did not execute a written contract. After working together for a few years, my client did not like how the other went about running the business. He left the business, then requested the money he was owed. The other party declined to pay. My soon to be client, contacted me for a free consultation and we discussed the matter. I attempted to resolve the case in pre-litigation, but the other side only threw mud and personally insulted my client. I filed the lawsuit and proceeded with litigation. As you can imagine, litigation was very adversarial. Opposing party did not want to provide any properly requested documents, tried to bring in irrelevant information, file frivolous motions, and a number of other tactics. All the litigation tactics the opposing tried were defeated in court. We won on each and every motion to compel, and soon the judge saw the case was emotional. After successfully winning numerous motions with sanction awards, the other side threw in the towel and paid my client exactly what he wanted.
