The State Court of Cobb County granted the motion for summary judgment filed by defendant GAPVT Motors, Inc. in David Johnson's action for fraud and violations of Georgia's Fair Business Practices Act ... in connection with his purchase of a car from GAPVT. The Ga. Court of Appeals found that material issues of fact remained as to each element of Johnson's claim under the Georgia's Fair Business Practices Act and that the trial court erred in granting GAPVT's motion for summary judgment on that claim.
