This is a wrongful death case in which John Flood represents the Brown plaintiffs. One of the defendants,WCM Group, an engineering firm, filed a motion to dismiss on grounds that the Brown's failure to ... include a certificate of merit with their initial pleading required dismissal, CPRC 150.001. The trial court denied the motion, finding that the Brown's had shown good cause for their failure to include the certificate. WCM appealed to the 13th Court of Appeals. The court, in an issue of first impression, held that the trial court did not abuse its discretion in failing to dismiss. Ms. Shackelford handled the trial briefing and was lead counsel on appeal.
