I hired JP Sarmiento and Glen Yu with the Sarmiento Immigration Law firm to help me apply for a J-2 waiver of foreign residency requirement (dependent turning 21), so I could consequently file for an H1-B work visa. Previously, my employer and I spoke with an established attorney firm in town on refe...rral (I work in a large city in the Midwest), and found that they were not knowledgeable and were unable to cater to my situation in the least (although they tried to bluff through it). Luckily, I was able to find Mr. Sarmiento’s exceptional firm through research, contacted them and started working with them right around New Year’s. By early January all the required documents were filed, and by the end of January I received a favorable recommendation from the DoS. By the end of February, my waiver application was successfully approved by the USCIS. Attorney JP Sarmiento and his law firm Sarmiento Immigration is absolutely the best immigration attorney you can find in the United States. We had a complicated case (see details below) and Mr. Sarmiento handled it with such expertise that the result exceeded all our expectations. He is not only an e...xpert at the laws regarding immigration, but also an excellent, professional, courteous, and honest attorney. I was impressed by Mr. Sarmiento’s knowledge of the immigration laws, his excellent communication skills (I always got a response from him in less than 24 hours), and his understanding of our particular case. He made us feel that we were his only clients. He created a strong cover letter for the DHS and Immigration Court, and knew exactly which documents needed to be attached to provide them sufficient proof that my wife’s case deserved a favorable exercise of discretion. By law, DHS is not under any requirement to open old ‘granted withholding of removal’ cases. That is, they can deny your case for any reason, and don’t even have to give you a reason. Therefore, presenting a strong argument is essential and Mr. Sarmiento accomplished this. About our case: I am a U.S. citizen and my wife was on “granted withholding of removal” status when we got married. When we wanted to adjust her status to a Permanent Resident based on our marriage, we started researching attorneys. After talking to at least a dozen attorneys, I realized that very few had experience with situations where it had been more than 90 days since the withholding of removal was granted. Then, I came across Mr. Sarmiento’s blog/website and found out that he had experience with such cases. I contacted him via e-mail, explaining our situation and asked him for advice and a quote. I was pleasantly surprised when I received a thorough response from him in less than 24 hours, explaining everything in detail. Keep in mind that some of the attorneys wanted $75 to $100 fee for an initial consultation before they even started talking to us. At that time, against my better judgment, I decided to retain another attorney just because she was based out of our city and Mr. Sarmiento was in Cleveland. I thought having a local attorney would be better in terms of communication. That was a big mistake. Long story short, after several hundred dollars in attorney fees and $1070 in USCIS fees, our case was denied because of poor advice by our attorney (USCIS didn’t have jurisdiction over our case, and the attorney should have known this!) That is when I contacted Mr. Sarmiento again and retained him to represent us. The difference between him and our previous attorney was clear from the beginning. Mr. Sarmiento responded to my e-mails right away, and always provided clear, detailed explanations. He told us how to terminate the proceedings in court so that USCIS will have jurisdiction over my wife’s case. He guided us to file a Joint Motion to Reopen with the Department of Homeland Security. He followed up with them every two weeks, and sent me an update, without me even asking for it. When the DHS didn’t take any action for a couple of months, Mr. Sarmiento filed a Sua Sponte Motion to Reopen with the Immigration Court. At the same time, DHS agreed to join our motion to reopen (therefore we didn’t need to pursue the sua sponte motion). The Immigration Judge reopened the case, and at the same time terminated proceedings without us having to go to court. Now my wife is able to adjust status by filing an I-485 with the USCIS since they do have jurisdiction now. Thanks to Mr. Sarmiento, my wife can finally become a United States citizen. I highly recommend Sarmiento Immigration Law Firm and would definitely contact them again if a family member or friend is looking for an immigration attorney.
