Confused. Both of you are on H-1B yet both of you may be on H4? One should still be on H-1B, and if that person’s I-140 is approved, the H4 spouse...

Depends what the position requires. If a BS + 5 yrs exp or Masters, then EB2. If less but w/ at least a BS, then EB3.
