Emily E. Gilbert is a 2005 graduate from the Cleveland Marshall College of Law and was admitted to practice law in Ohio in 2006. She joined Margolius, Margolius and Associates in 2006 as an associate attorney. She completed her undergraduate degree at Binghamton University in 2000, with a Bachelor of Arts in English.
Emily has worked extensively on ERISA / Long Term Disability cases, SERS, OPERS, STRS, and Social Security disability claims since joining the firm. She also enjoys practicing in the civil rights areas of housing and employment discrimination. She previously argued before the 9th Appellate District of Ohio in a case which established a landlord’s duty to act to prevent discrimination between tenants, when notice of the discrimination is given. In addition, Emily has written briefs for both the U.S. Northern District of Ohio and the U.S. Sixth Circuit Court of Appeals advocating for an expansion of employees rights under ERISA. She has made this area of the law, which notoriously favors large insurance companies, one of the larger focuses of her practice.
Emily is admitted to practice before all Ohio Courts, as well as the Federal Court for the Northern District of Ohio, the Federal Court for the Southern District of Ohio, and the U.S. Sixth Circuit Court of Appeals. She is also a member of the Ohio Employment Lawyers Association, Cleveland Employment Lawyers Association. It is Emily’s goal to broaden the rights of employees in the workplace when they become sick and disabled. In her free time, she is a mother of two and volunteers her time with the J.D. Breast Cancer Foundation.

Extremely knowledgable and thorough
I was laid off and felt I was discriminated against by my employers. Never being in a situation to need legal advise I was checking with different attorneys for information.
After my initial consultation at the law firm Emily Gilbert and I met and she was assigned my case. I felt both confident and comfortable with Emily.
She was knowledgeable, professional and very thorough.
As we went through the lengthy process she was always available to address my concerns and questions. I always felt she was invested in my case an was fighting to attain me the best results possible. When it came to making decisions with me she was always forthright and honest which was very helpful.
With all that is involved in a lawsuit especially continuously facing your former employer, it can be a very stressful situation. She certainly helped make that process easier for me.
