We represented appellee, William Mangano, in a civil appeal from the Cuyahoga County Court of Common Pleas. Appellants, 1033 Water Street, L.L.C. and Robert Rains (“appellants”), appealed the trial cou ... rt's decision to grant a permanent injunction to appellee, William Mangano, ordering appellee, Water Street Condominium Owners' Association (“Association”), to conduct a special election of its board of directors within 30 days and barring appellants from “participating, voting in or otherwise influencing the special election” as well as any future election of the Association's board of directors. The Mangano Court held the trial court did not abuse its discretion in granting the appellee's motion for permanent injunction. The Mangano Court further held the trial court did not error in finding that Belvedere [Condominium Unit Owners' Assn. v. R.E. Roark Cos., Inc., 67 Ohio St.3d 274, 617 N.E.2d 1075 (1993) ] bars a condominium developer, who is also a unit owner, from participating in elections of the board of directors.
