In regards to my litigation involving a septic system dispute.

When it became apparent that I would have to embark on a legal dispute involving the septic system at my residence I found myself rather lost on where to turn. I had never been involved in having to sue anybody in my life and this was completely uncharted territory for me. Mark was referred to me wit...h high regards and after he took the time to listen to my projected case it became obvious that his counsel would be my best option. His explanations on matters at hand were very sharp, highly knowledgeable, and easy for me to understand. His process was direct, appropriate, and without any sense of ego. Every step was highly well-prepared and comforting. I felt like he had a plan A, B, C, etc. when it came to attacking problems along the way. If I would ever need his counsel again I would not hesitate to contact him and would recommend him to anybody.

Legal Representation

I hired Mark to represent me to handle a couple of issues. The first was out of state. Mark charged me to review and draft a letter but when it came time to dealing with matters, he advised me to hire someone from that state leaving their legal counsel hanging in the wind . He could have immediately ...told me once he found out it was out of state, that he wouldn't be much help. The second issue was a wrongful termination case. When the same correspondence was going back in forth between Mark and the other legal counsel with nothing being accomplished, I confronted him on it. I expressed my frustration of paying him to represent me and not just sending emails. He took immediate offense to this and terminated our agreement. Again, Leaving the other legal counsel hanging in the wind with no response to their last correspondence. Mark display of behavior was unprofessional and a waste of money. I am no further ahead than i was the day i called him. I would not recommend him to anyone, unless they needed a paralegal.

Summary judgment for the title insurance company was affirmed. There was no evidence in the record to support a finding of bad faith. Court also found that escrow functions are outside of the scope of agency for a title insurance agency agreement.
