Mrs. Hartman was survived by three children, including the Executor. He will provided that all personal and household effects be divided among her children as they may agree. In the absence of agreem ... ent, the executor was given the discretion to divide the property in shares as equal in value as practicable. One son filed objections to the First and Final Account which raised numerous issues, including the manner in which the personal property was distributed. All the personal property was appraised by an independent auctioneer. A complete list was circulated to all beneficiaries who were given an opportunity to select the items they wanted. A second list of unselected items was then circulated. The Executor scanned 4,500 family photographs and gave each a digital copy as well as 1,500 original photographs. The objector testified that his problem was that he did not get the photos he wanted. The Judge found the administration was done completed properly including the sale of the decendent's residence to his girlfriend at the appraised value less the real estate commission that would have been paid in a third party transaction.
