Billy Norton and Donna Norton, Appellants, v. Newberry Home Center, Inc. and Wayne Turner, Defendants, Of whom Robert A. Turner and William B. Ackerman III, as Personal Representatives of the Estate of ... Wayne Turner, are the Respondents. Billy and Donna Norton appeal the trial court's ruling in favor of Wayne Turner in their negligence cause of action arising from the delivery and set-up of their mobile home. I represented Mr. Turner at the trial level, and was successful in proving no fault by him. The Court of Appeals agreed with that ruling and affirmed the decision of the trial court.

This action was originally filed by Appellant on March 7, 2011 in the Family Court for Greenwood County, alleging the presence of a common law marriage, and seeking, among other things, separate suppor ... t and maintenance from the Respondent. (Complaint). Respondent filed an Answer and Motion to Dismiss on March 30, 2011, based upon the fact that the Respondent “lacked the capacity to enter into a common law marriage.” (Defendant’s Answer). On April 5, 2011, the Motion was heard by The Honorable W. Marsh Robertson (hereinafter Judge Robertson), who subsequently issued an order granting the Motion on April 18, 2011, after considering both parties Memorandums of Law on the issue. (Order of Dismissal, Transcript from April 5, 2011, Appellant’s Memorandum of Law in Opposition to Motion to Dismiss, Respondent’s Memorandum of Law in Support of Motion to Dismiss). Appellant filed a Motion to Alter or Amend on May 5, 2011, to which Respondent filed a Response. (Appellant’s Motion to Alter or Amend, Respondent’s Response to Motion to Alter or Amend). The matter was heard and denied by Judge Robertson on May 16, 2011. This appeal followed. Note: I was not involved at the trial level but defended Mr. Simmons on the appeal, in which we were successful.
