OUTCOME: Trial victory at Bankruptcy Court level. We were awarded attorney's fees and costs in the victory. Additionally, Appeals Court affirmed the Trial Court's decision.

Louisiana Central Credit Union v. Byron Stewart; adversary case #17-1052; US BK Court for EDLA. Creditor sought to declare loan account of Chapter 7 debtor non-dischargeable because debtor filed bankr ... uptcy within 90 days of obtaining loan. Creditor took the case to trial even though did not have a substantial justification for bringing adversary proceeding as did not possess any evidence that debtor intended to defraud creditor at time of receiving loan. Judge ruled in our favor and awarded attorney's fees. Creditor appealed. Appeals Court affirmed the Bankruptcy Court's decision.

OUTCOME: Obtained trial victory for client in Bankruptcy Court against ex-husband after he had attempted to discharge debt related to their divorce agreement.

Louis Kirkland, Jr. v. Kimberly Evans, adv proc # 15-1055; US BK Court for EDLA Filed lawsuit against ex-husband in Bankruptcy Court seeking to declare debts non-dischargeable, under 11 U.S.C. §§ 52 ... 3(a)(2), (a)(5), and (a)(15). Court ordered that ex-husband could not discharge $25,000.00 that he had promised client in exchange for her ownership interest in their community property residence.

OUTCOME: Successfully opposed the Motion for Summary Judgment that was filed by our clients' insurance company. MSJ denied.

Our clients' UM / UIM automobile insurer filed a Motion for Summary Judgment to attempt to dismiss our "bad-faith" litigation, which we had filed subsequent to insurer's decision to deny our clients' U ... M / UIM bodily injury coverage for a "miss-and-run" automobile accident. The Court held that we had proven genuine issues of fact existed, related to whether the insurer acted timely or whether its actions were "...unjustified, without reasonable or probable cause or excuse."

OUTCOME: We fought the client’s mortgage company at the Bankruptcy Court and Appellate levels and saved our client's residence from foreclosure, while also saving her thousands of dollars

At the Bankruptcy Court level, we successfully opposed our client's mortgage company's request to file a late amendment to the proof of claim that we had filed on our client's behalf and to dismiss our ... confirmed Chapter 13 plan, which contained less pre-petition arrears than the mortgage company alleged. The mortgage company appealed the Bankruptcy Court's decision, and we filed an opposition brief. At the Appellate level, the Honorable Lance M. Africk held that the bankruptcy court did not abuse its discretion in denying the mortgage company's request to amend our proof of claim and that our confirmed Chapter 13 plan was valid, even though it contained less pre-petition arrears than the mortgage company had alleged.
