Issue of first impression on appeal. A child was born to a lesbian couple during the legal marriage of the couple. The birth mother was named as a parent on the birth certificate, but the other mothe ... r was not named as a legal parent. We believe that both mothers should be named as legal parents, just as a husband in the same position would be named as the legal father. Any denial based on the gender of the parent is blatant sex-based discrimination.
