Pennsylvania State Troopers Association v. Col. Jeffrey B. Miller, 621 Fed. Supp. 2d 246 (M.D. Pa. 2008).

OUTCOME: Summary Judgment granted in favor of Troopers Association.

An action was brought by the Pennsylvania State Troopers Association and its President against the Commissioner of the Pennsylvania State Police maintaining that a policy of the State Police violated t ... he Americans with Disabilities Act (ADA) because it required troopers to disclose the nature of illnesses when requesting sick leave in violation of the ADA. After both parties filed Motions for Summary Judgment, the Court granted the Troopers Association’s Motion for Summary Judgment and denied the Commissioner’s Motion. Without going to trial on the basis of a Motion for Summary Judgment, we were able to obtain a judgment invalidating a policy under the Americans with Disabilities Act. Judge Christopher C. Connor issued his decision on September 30, 2008.

OUTCOME: Judgment for Detectives Association.

The County Detectives Association (Union) filed a grievance maintaining that the District Attorney’s Office had violated the Collective Bargaining Agreement between the Union and the County by scheduli ... ng a detective outside the perimeters of the Collective Bargaining Agreement. The grievance was sustained by an Arbitrator and the District Attorney appealed the case to the Court of Common Pleas of York County. After the Court of Common Pleas affirmed the Arbitrator’s Award, the Commonwealth Court affirmed the lower court’s ruling. The case clarified the standards that are applied in situations where a row officer maintained provisions of a collective bargaining agreement were in violation of Section 1620 of the County Code, 16 P.S. §1620.

OUTCOME: Judgment for Claimants.

In June, 2002, the United Food and Commercial Workers represented the employees of Schott Glass and were engaged in collective bargaining negotiations. After negotiations did not produce a new collecti ... ve bargaining agreement, the bargaining unit members engaged in a work stoppage and subsequently applied for unemployment compensation benefits. One employee’s application for unemployment compensation benefits went to hearing and was to set precedent for all of the employees engaged in the work stoppage which totaled approximately 450. The Unemployment Compensation Referee granted benefits determining that the work stoppage was a lockout under the Unemployment Compensation Law. The Unemployment Compensation Board of Review affirmed the case and the matter was first heard by a panel of the Commonwealth Court of Pennsylvania. The Panel then rescheduled argument before the Court En Banc. The Commonwealth Court of Pennsylvania affirmed the decision of the Unemployment Compensation Board of Review.

OUTCOME: Judgment for Plaintiff.

Plaintiff was on maternity leave and was terminated by her employer. An action was brought pursuant to the Civil Rights Act and the Family Medical Leave Act. After a jury trial on December 6 and 9, 1 ... 999, a jury returned a verdict in favor of the Plaintiff indicating that the employer had violated the Family Medical Leave Act. This was the first jury verdict in favor of a Plaintiff in the Middle District of Pennsylvania. An Appeal by the Defendants to the Third Circuit was denied.
