An action was brought by the Pennsylvania State Troopers Association and its President against the Commissioner of the Pennsylvania State Police maintaining that a policy of the State Police violated t ... he Americans with Disabilities Act (ADA) because it required troopers to disclose the nature of illnesses when requesting sick leave in violation of the ADA. After both parties filed Motions for Summary Judgment, the Court granted the Troopers Association’s Motion for Summary Judgment and denied the Commissioner’s Motion. Without going to trial on the basis of a Motion for Summary Judgment, we were able to obtain a judgment invalidating a policy under the Americans with Disabilities Act. Judge Christopher C. Connor issued his decision on September 30, 2008.
