Majestic v. Huntington National Bank
Aug 31, 2017OUTCOME: MTD Overturned
We won this Sixth Circuit federal appellate case that set national law in the area of check cashing. Specifically, that UCC Article 4's obligations on banks to only cash properly payable checks could ... not be completely abolished by contract. Here, Huntington cashed a clearly fraudulent check but refused to refund the money because our client did not buy a special protection program. The court found that doing so could have violated the law and reinstated our class action lawsuit. This decision in the first in the country on this issue at the federal appellate level. It's a win for consumers.
