A manufacturer of bases for laundry equipment sued my client in federal district court in Nevada alleging trade disparagement, antitrust and several other business torts. We prevailed at the district ... court level, and at the Ninth Circuit Court of Appeals. Plaintiff sought certiorari before the United States Supreme Court, which was denied.
OUTCOME: The Clean Water Coalition prevailed.
Mr. Kealy was lead counsel in a landmark case decided by the Nevada Supreme Court that prevented the Nevada Legislature and Governor from enforcing an unconstitutional tax enacted to sweep $62 million ... from the funds of a local governmental agency to the state’ s general fund (Clean Water Coalition v. The M Resort, LLC, State of Nevada, 2011). The precedent established by this case prevented over $650 million in sweeps from local governmental entities and municipalities across Nevada during the 2011 legislative session and defined the state constitution’s limits applicable to taxes, special laws and local laws.
OUTCOME: The District Court's ruling was upheld in favor of my client.
This case involved multiple state and federal claims under the Fair Housing Act and civil rights laws arising out of a tenancy. I represented the defendants successfully and the matter was appealed to ... and argued before the Ninth Circuit Court of Appeals. My clients prevailed.
