Felon in Possession of a Firearm and OWI 2nd. The defendant in this case was charged with operating while intoxicated second offense. After he was arrested and transported to jail the law enforcm ... ent officer conducted a search of his vehicle. The search of the legally parked vehicle nearly 20 minutes after arrest yielded a firearm. Unfortunately the Defendant was a convicted felon. The officer returned to jail and charged the Defendant as a felon in possession of a firearm, a class D felony. I challeneged the legality of the search of the vehicle. The issue was briefed prior to suppression hearing. The judge agreed with my argument and suppressed the firearm.
