OUTCOME: NOT GUILTY verdict on OUI, and DISMISSAL of REFUSAL charge after successful appeal to Alaska Court of Appeals.

Client charged with DUI and Refusal to submit to breath test. Jury returned a NOT GUILTY verdict on the OUI charge at trial. Slone sucessfully appealed to the Alaska Court of Appeals, argauing that t ... he trial judge gave erroneous jury instructions on the Refusal charge. The court of appeals agreed, and the Refusal charge was then dismissed by the prosecutor. Ultimate result: no conviction on either charge.

OUTCOME: Dismissal of all DUI, Felony Eluding and all charges

In that case an officer attempted to conduct a stop of a client, for failure to have headlights activated. The officer mistakenly thought that headlights were required, but the law did not require hea ... dlights for another 15 minutes. The client did not stop; instead driving across a department store parking lot, with the officer pursuing with overhead lights and siren on. The client then drove over a curb, across four lanes of traffic, and over the curb on the other side of the street where his van came to a stop on the sidewalk. The client then jumped out, pulled some boards off a fence and ran through the fence to the yard of a resident, who tackled the client until the police arrived in pursuit. The client was charged with felony eluding, DUI, criminal mischief, and resisting arrest. The court ultimately held that the client’s illegal actions in attempting to elude would be suppressed, since the client’s actions stemmed from the officer’s illegal attempt to stop the client. All charges were dismissed. The decision was based on a violation of the search and seizure clause of the Alaska Constitution .

Municipality of Anchorage v. Reekie, 1999 WL 91810 (Alaska Appellate No. A-6447, Feb. 24, 1999)

OUTCOME: DISMISSAL OF DWI, Refusal, and Driving While License Revoked.

DISMISSAL of all charges after Slone filed motion to suppress all evidence obtained after arrest, based on illegal seizure by police. 911 callers reported client as suspected intoxicated driver. Offi ... cer in the area followed client and activated overhead lights. Client continued driving for a few blocks and pulled into his garage. Officer came into garage to make contact with client, and arrested client. Client ultimately charged with DWI, Refusal to Submit to Breath Test, and Driving with a Revoked License. Slone filed motion arguing that the officer's entry into client's garage violated search and seizure clause. After a hearing the trial judge granted Slone's motion, suppressing all evidence after the officer entered the garage without a warrant. The Municipality of Anchorage filed an appeal to the court of appeals. The Alaska Court of Appeals agreed with Slone's argument that the officer violated client's rights against unreasonable searches and seizures. All charges were dismissed.

OUTCOME: DISMISSAL of DWI charge, after successful appeal to Alaska Court of Appeals on violation of search and seizure rights.

DISMISSAL of DWI charge after Court of Appeals holds that stop was illegal. Client stopped after a 911 caller reported client as a suspected intoxicated driver. Officer arrived in the area and saw cl ... ient walking from car to the front door of house. Officer called out to client and client ultimately came out to talk to officer. Field sobriety tests conducted and client arrested for DWI. Slone filed a motion to suppress all evidence after the stop, on the grounds that the initial contact by police violated client's right against unreasonable searches and seizures. After a hearing in the trial court, Slone filed an appeal to the Alaska Court of Appeals. The Appellate court held that the officer's actions in contacting client violated client's rights against unreasonable searches and seizures. The DWI charge was dismissed.

Hoff v. Municipality of Anchorage, 1997 WL 411591 (Alaska Appellate No. A-6333, July 23, 1997)

OUTCOME: DWI DISMISSED, after successful appeal to Alaska Court of Appeals.

Dismissal of DWI charge after successful appeal to Alaska Court of Appeals. Client stopped after officer saw client walk between two closed businesses late at night, enter a car on the passenger side, ... and fail to first brush snow from windshield. Client arrested and charged with DUI. Slone filed a motion to suppress all evidence after the stop, on the grounds that the stop was illegal in violation of the search and seizure clause. After an evidentiary hearing in the trial court Slone appealed to the Alaska Court of appeals. The appellate court agreed, holding that while the client's actions were suspicions, the prosecution had failed to prove that the was enough evidence to justify the stop. Charge dismissed.
