The appellate court found that the conviction of t ... ampering with evidence was not supported by sufficient evidence where girlfriend's remarks about finding drugs on defendant's dresser prior to arrest did not alert defendant about pending investigation, and defendant's continued open sales of heroin in public supported a finding that defendant did not know an investigation was likely to occur when he hid drugs, R.C. 2921.12(A)(1). The appellate court vacated Defendant's conviction for tampering with evidence, effectively vacating 36 months of the Defendant's total sentence.
