Motorcycle v. Car accident that occurred in the universal turn lane of a major highway in Lake Havasu, Arizona. The plaintiff, who was operating the motorcycle, sustained injuries including a broken h...ip, broken femur, and broken wrist. At the time of the crash, the plaintiff was traveling in the universal turn lane, intending to turn left at the next intersection about 500 feet ahead. The defendant made a left turn into the center turn lane from a private drive directly in front of plaintiff's path of travel, resulting in a collision. Plaintiff sued for personal injury and Defendant asserted a defense of contributory negligence, arguing that the Plaintiff had entered the center turn lane too early. Plaintiff's rental property caught fire and was totally destroyed. When the Plaintiff's opened the claim with their homeowner's insurance company, the claim was denied. The Plaintiffs had recently sw...itched homeowner insurance carriers. When the switch was made, their agent failed to exercise reasonable care in forwarding all documents to the new insurance company. As a result, the new policy was never in effect. Plaintiffs filed suit alleging negligence against their agent. A thorough search for other insurance was conducted and revealed that the previous policy was still applicable under Arizona law. Plaintiffs settled their case for an amount higher than the replacement cost of the home.
