I consulted Myles Holbrook, Prosecuting Attorney for West Liberty, Morgan County, Kentucky, regarding a theft by deception matter. I disseminated the details to him. He did not get back to me, and five days later the accused visited his private practice office and was consulted, and an agreement draf...ted by a partner of his firm, for this individual. In the agreement, they added a "non-disparagement" clause, which is clearly an ethical and legal violation of the Consumer Review Fairness Act, and automatically voids and makes uneforceable said contract. Honest reviews are protected and such an agreement cannot be imposed or enforced by a contract or an agreement, which would stop someone from posting a truthful review about shoddy work performed. I consulted Myles Holbrook in his capacity as a County Prosecutor, not directly through is private practice, but through the Government site, to assist me with a complaint of "Theft by Deception." As the County Prosececutor, a retainer is not needed. It is his job to uphold the law. Allowing this man who I was attempting to bring charges against to consult his law firm, violates his oath of office to uphold the law. It also violates the Former Client Rule, SCR 3.13(1.9) as well as Conflict Imputation SCR 3.13(1.10) . The individual Prosecutor, nor his private firm, can represent the accused unless he requests written consent from the accusor, me, which he did not.
