This is a landmark case in the State of Utah on gun laws. In summary, after a night of heavy drinking at a party hosted by the Defendant, the Plaintiff picked up Defendant's loaded handgun and accident ... ally shot herself in the head, killing her. The district court granted summary judgment for Defendant, reasoning that Plaintiff was a house guest to whom Defendant owed no duty. The Supreme Court, however, reversed, holding that gun owners have a duty in tort to exercise reasonable care in supplying their guns to intoxicated individuals.
