Our client, a doctor, was the sole trustee of his deceased mother's trust. Our client's sister filed a lawsuit against our client alleging breach of fiduciary duties and requesting the court remove him ... as trustee. Furthermore, the complaint alleged that our client abused his discretion as trustee to benefit himself, failed to administer the trust in good faith, failed to keep plaintiff reasonably informed of the activities of the trust, failed to account for the trust, actively concealed assets belonging to the trust and improperly distributed funds to himself despite notice imposing a claim on such funds.
