At our law firm, we try to educate our clients about the law applicable to their case. In this matter, child support and the calculation of child support was at issue. In Kentucky, child support is calculated according to specific statutory guidelines, which does not include debts or net income of the parties. In other words, it is irrelevant to the Court if a child support obligee has a large debt or other significant living expenses. Child support is based on gross income first. In order to modify the child support calculation, the Court may consider the parties’ parenting schedule with the issue being that increased parenting time may result in a reduced child support obligation; however, nothing is guaranteed. All this information is explained to every client, but it is ultimately their decision with regard to how the case is handled.
