I wish I could say I won this one, however, it was a fun and challenging case to be involved in. We argued that since our client's property was already enrolled in Clean and Green Program, ACT 235 did ... not apply to them and their home acre should continue to receive benefit of the program. The trial court agreed with our position and the Board appealed. I argued the case to the three judge panel of the Commonwealth Court but the Court reversed the trial court's decision. I got my hopes up when after we filed a Motion for Reconsideration, a full panel (9 judges) of the Commonwealth Court agreed to hear the case again. And the trial court was reversed again.
