Appellate Co-Counsel for the City of Tucson. In this wrongful death lawsuit, the jury awarded the parents $40 million, holding the City 33% responsible. The trial judge reduced the judgment to $12 mill ... ion. On appeal, the Arizona Court of Appeals found that opinion testimony from lay witnesses was impermissible. The Court of Appeals vacated the judgment, and sent the case back to Superior Court for a new trial.
