Today we received an approval to cancel the imminent deportation of a person who overstayed their Visa Waiver! The person is married to a U.S. Citizen with very serious medical problems, including ... lupus and chronic renal failure. One of the USC's children also has a learning disability. A Visa Waiver violation (even an overstay by one day) generally subjects one to deportation even if they have U.S. Citizen family. In this case, deportation was Ordered last week and the client was taken into Federal custody. However, we were able to convince the Buffalo Deportation Office to cancel that Order, release the client from Federal custody, and allow the client to remain in the U.S. for at least the next year so that he can continue to care for his ill wife and her child, as her conditions were rapidly deteriorating without him.
