Mr. Sanchez, our client, was traveling eastbound on Carillo Way in the #3 lane of the intersection of Melrose Dr. in Carlsbad CA when the defedent Sergio San Elias ran a red light witha vehicle owned ...by Patricia San Elias. The defendent sped up to try and make the light but when he entered the intersection the light was red. Plaintiff's car overturned and Mr. Sanchez was tossed about his car. HIs vehicle sustained major damage. Mr. Sanchez was transported by ambulance to Tri-City Medical Center where he was treated for back pain. Through settlement our client obtained $100,000, which was the policy limit on the case.

This was a heavily disputed “illegal lane change†case.
On July 20, 2006, Plaintiff Hernan Cortez (“Plaintiffâ€) was involved in a severe motor vehicle collision. Plaintiff was operating a mot...orcycle while traveling southbound in the number one (1) lane on Euclid Avenue, north of Edison Avenue in the city of Chino. Defendant Nicholas Tavasci (“Mr. Tavasciâ€), while in the course and scope, was operating a tractor trailer and hauling livestock for Defendant Wingfield Livestock from Arizona to Chino, California. Mr. Tavasci had been travelling all night and was only a couple of miles from his intended destination, located off of westbound Euclid Avenue.
Prior to the collision, Mr. Tavasci was traveling southbound on Edison Avenue approaching Euclid, where he intended to make a right hand turn. Mr. Tavasci then illegally entered the left hand turn pocket, and used the left hand turn pocket to make a right hand turn onto westbound Euclid, in violation of CVC §22100. Defendants claimed that Plaintiff was travelling at an unsafe speed and was not a competent rider because he did not have a license to operate a motorcycle.
The collision between Plaintiff’s motorcycle and Mr. Tavasci’s semi-truck was significant. When Mr. Tavasci went from the left hand turn lane, without signal or warning into Plaintiff’s lane of travel, Plaintiff’s motorcycle broadsided the passenger side of Mr. Tavasci’s livestock trailer. Consequently, Plaintiff’s body was rag dolled underneath Mr. Tavasci’s trailer. Plaintiff could not make any evasive maneuvers. Plaintiff was knocked unconscious. When Plaintiff regained consciousness, he realized that his left leg was crushed and his broken leg bones were protruding through his torn jeans.
Plaintiff was transported via ambulance to Arrowhead Regional Medical Center where emergency surgery was performed to stabilize the compound fracture of Plaintiff’s left tibia and fibula.
He had obtained an attorney after the accident however his case was discharged. He called the Law Offices of Ryan Harris and we took over his case. A favorable settlement in our clients favor was reached.

A San Diego client retained the Law Offices of Ryan Harris in the summer of 2006. She had been involved in a motor vehicle collision a year earlier. The insurance company for the defendant had taken th...e position she was 60% responsible for the accident. As a result, the insurance company had only offered the client a couple of thousand dollars to settle her case, despite the fact that she had sustained significant neck, right shoulder, and lower back injuries. The case went to trial in May 2008, nearly 3 years after the accident. The jury returned a $365,000 verdict, with $100,000 awarded for past medical expenses, $40,000 awarded for future medical expenses, $25,000 awarded for past pain and suffering, and $200,000 awarded for future pain and suffering. Post trial, a memorandum of costs was filed and the trial judge awarded an additional $99,666 in addition to the $365,000 verdict for prevailing party costs, and CCP Section 998 interest and costs. After the Judge's rulings, the insurance company agreed to pay $465,000 to satisfy the judgment.

Following a 3 1/2 day trial, the jury returned a $29,000 verdict, with $14,000 awarded for past medical expenses, $7,500 awarded for future medical expenses, $3,500 awarded for past pain and suffering, and $3,500 awarded for future pain and suffering. In addition to the jury's $29,000 verdict, the insurance company will also have to pay prevailing party costs, and CCP Section 998 interest and costs, of about $18,000, requiring a total payment of approximately $47,000 to satisfy the judgment.
