OUTCOME: Prevailed at the Ninth Circuit
This case was argued before the Ninth Circuit on December 6, 2012 alongside the NRA backed case San Diego County and Second Amendment Foundation back ed case Richards v. Prieto. All cases primarily dea ... lt with the legal question does the Second Amendment confer a right outside the home and this decision will be dispositive in deciding this issue in the Ninth Circuit. Description: This is a landmark case in which a conceal and carry permit is sought on behalf of a fit and otherwise qualified applicant. This case will change the law in Hawaii and advance civil rights throughout the nation. We have prevailed at the Ninth Circuit. Unless the Defendants move for a petition to be heard by the Supreme Court or for en banc proceedings this matter will be remanded to the lower court to overturn Hawaii's handgun career law. As a practical matter Hawaii will be shall issue in the very near future.
OUTCOME: complete
I represented the Hawaii Office of Disciplinary Counsel in returning files, trust accounts and finacial papers back to their rightful owners. These items had been seized after the defendant resigned f ... rom the bar. This case was especially difficult as the case began in 1999 and by the time I became Trustee most of the clients had passed on.
OUTCOME: Prevailed
Lawsuit over HPD's practice of deleting facebook posts based on content (unfavorable to the HPD) and banning citizens from participation in the forum. The Defendants have admitted fault in this matte ... r and we have prevailed.
OUTCOME: preliminary injunction enter case ongoing
This is a case arising from a firearm owner being convicted of a misdemeanor in 1997 and being denied his right to bear arms. The plaintiff has already won on a preliminary injunction. I represent the ... Hawaii Defense Foundation which is amicus curiae in the ongoing case. I will be arguing at the MSJ hearing on July 7th, 2013.
OUTCOME: on appeal to the Ninth Circuit
This case was a pro se case that was dismissed from the United States District Court of Hawaii on a motion to dismiss by having Mr. Young's prayer for relief ignored. I have filed the Opening Brief an ... d wait for the Defendant's Answering brief which is due April 25th. This is the first case in the nation's history that asks the questions are rifles, shotguns, and knives protected by the Second Amendment. It is a companion case to Baker v. Kealoha. The government of Hawaii declined to respond to any of the contentions raised in this appeal other than to defend Hawaii's handgun carry law which we already received a favorable ruling on in Baker v Kealoha. This appeal is much more complicated than I am indicating here. The Ninth Circuit has already adopted a argument made in this appeal regarding ammunition in a related appeal. The Ninth Circuit is now the first Circuit to hold all ammunition restrictions must survive constitutional scrutiny.
