Nathan C. Lybarger operates with a shocking level of professional negligence and a complete disregard for federal law. If you are a consumer or a service member facing this attorney, do not expect standard professional conduct. After receiving a civil detainer, I immediately made multiple diligent, g...ood-faith attempts to contact his office, leaving detailed voicemails outlining an explicit out-of-state conflict that physically prevented me from appearing at the hearing. Rather than returning the communication or seeking a standard professional courtesy continuance, Lybarger intentionally exploited a pro se defendant’s absence to rush a default judgment. He used this calculated shortcut to weaponize a minor, rectifiable balance of under $1,800 into a predatory $6,000 judgment by stacking on egregious, unverified fees. Most critically, Lybarger’s conduct represents a blatant violation of federal statutory mandates under the Servicemembers Civil Relief Act (SCRA). Federal law explicitly requires a plaintiff’s counsel to verify military status and file a certified affidavit before a court can legally grant a default judgment. Lybarger completely bypassed this strict requirement, executing aggressive asset tracking and wage garnishments against a protected military dependent who was simultaneously recovering from a severe, documented auto accident. His systemic failure to verify military status has caused catastrophic collateral damage to my housing security and employment capabilities. A formal disciplinary complaint has been logged with the Tennessee Board of Professional Responsibility, alongside federal consumer protection filings. Nathan C. Lybarger relies on unrepresented defendants not knowing their rights so he can rush illegal defaults through the court system. His deceptive practices are an embarrassment to the Tennessee bar.
