Superior Elder Care Attorney and team

We are repeat customers of Takacs. Our first interaction with the firm happened after we moved to Hendersonville. Tim and his staff helped us move our Michigan family trust to Tennessee and we saved several hundred dollars a year not having to pay state income taxes in Tennessee. Our next experience... happened when my disabled sister and her disabled husband moved from Virginia to Tennessee. My brother in-law’s disability and declining health had created a lot of outstanding debt. My sister wanted to determine if her husband qualified for Medicaid or any other public benefits that could pay his medical expenses. He needed a will that wouldn’t jeopardize his eligibility for Medicaid. He also wanted to document his end-of-life wishes. Tim Takacs and his team of professionals experienced in nursing, Medicare and Medicaid worked together to help my brother-in-law navigate the complicated application process and get approved for Medicaid. They also provided solid advice to help him get accepted into a local nursing home so he could get the immediate care he needed—with Medicare paying the bill.  Now, 18 months later, my brother-in-law is healthier, has had needed heart valve surgery, and is now out of the nursing home receiving Medicaid assistance and therapy from the comfort of his own home. There will likely be more interactions. In the near future, we will be going back to Takacs McGinnis to have our Michigan Revocable Trusts updated; they were written 15 years ago, when our children still lived at home. Working with an expert team of professionals has been a big relief.  Tim Takacs and his team has saved us from paying unnecessary taxes and they have improved the life and financial situation for my sister and brother-in-law. Everyone on the team really understands the big picture. I recommend them highly.

He did not deliver on services as indicated.

My family visited Mr. Takacs in desperation in 2009. My elderly parents were living with me and we needed help with daily living tasks., but had limited finances. Mr. Takacs charged my parents $10,000 for a Life Care Plan. He also coached us on how to redistribute my parents' finances so they would... qualify for Veteran's benefits. He was very assuring that we would receive benefits SOON. My dad was a Merchant Marine in World War II and we are devastated by this! It is now 2015, both of my parents are dead and we have never seen one VA benefit dime. I would NEVER have taken a chance on this if Mr. Takacs had offered any doubt at all about my dad qualifying for benefits. My sister and I went through tortured days and nights over this.

In brief, this was a representation of husband and wife that began in June 2009 and ended in Feb. 2012. Husband died three months after the representation began. We continued the representation for the Wife. In June 2010 we did file a VA death pension claim on her behalf, but it was difficult and not approved, despite considerable effort by us. Our client moved out of state; therefore we would not continue to represent her and thus either appeal the VA claim or refile. We learned last year that she had died in May 2014. In short, this is an unfair characterization of our representation - certainly, it is false that I or anyone else in this office would ever "guarantee" VA would be approved. Not only would that be foolish for us to do so (we have no control over what the government does), that would be unethical.
