OUTCOME: Settlement

At the time it was settled, the $900 million dollar global settlement with Tenet HealthCare Systems was the largest civil settlement ever reached in a False Claims Act case. I served as lead counsel i ... n three separate qui tam (or whistleblower) actions alleging Stark and Anti-Kickback Statute violations filed in New Orleans, and as co-counsel in a parallel civil/criminal investigation of a Medicare Health Maintenance Organization that Tenet partially owned. As a result of my efforts I received the prestigious Department of Justice Attorney General Award for Fraud Prevention and the Office of Inspector General Cooperative Achievement Award.

OUTCOME: Conviction of Melville Borne

Melville Borne owned both a small chain of nursing homes and instead of using the monies he received for the care of his residents, he diverted significant sums to his real estate development company, ... paid himself a six figure salary, and spent lavishly on his 150 acre estate. We prosecuted Borne under a novel theory, and the case of United States v. Borne was the first to place criminal responsibility on a nursing home owner for failing to provide necessary services It resulted in the conviction and incarceration of Borne and the forfeiture of virtually all of his assets. The case was recognized by National Healthcare Anti-Fraud Association, and was deemed worthy of the Inspector General Integrity Award and the Department of Labor Exceptional Contributions Award.
