Divorce trial. The primary issue was the just and proper division of a home that the parties occupied during their 8 year marriage. The home had been acquired during the marriage but the source of th ... e funds used to purchase the home were from the sale of a home that husband owned before the marriage. Husband argued that he should be awarded his premarital asset free and clear of Wife. On Wife's behalf, I argued that any separate interest that Husband had in the home was commingled and should be divided in one-half. At the time of trial, the parites had two children, ages 6 and1, that had resided in the famiy home since their birth.
