We empathize with your dissatisfaction of the immigration officer's decision regarding your Naturalization application. We understand that navigating the Naturalization process can be challenging, and we strive to provide our clients with the best possible guidance and support. Regarding the statutory period for Naturalization eligibility, it is essential to clarify that individuals who received their green cards through marriage to a U.S. citizen and remain married to that U.S. citizen are indeed subject to a three-year statutory period. Your arrest for domestic violence (DV) occurred in 2018, and your probation was completed as of July 2019, officially closing your criminal case. Your application for Naturalization was subsequently submitted in January of 2023, thus placing your DV record outside the applicable 3-year statutory period. However, as discussed with you previously, in your case, the denial was not based on the timing of your application but rather on other factors, particularly the need to demonstrate good moral character to offset the effects of your criminal record. As you may recall, we stressed the importance of submitting concrete evidence with the initial filing of your application to establish good moral character in your case. However, despite multiple requests for more evidence, you proceeded with the documentation you deemed fitting. Consequently, during your interview, it was determined that further evidence of your good moral character was necessary due to your arrest and admission of guilt for DV. Because of your inability to provide such documentation, the immigration officer denied your case. We understand that this has been a difficult situation for you. We have thoroughly explained the reasons for the denial and provided comprehensive guidance on how to address the issue through a timely appeal with the correct documentation. Our primary aim is always to advocate for our client's best interests and provide them with the unwavering support they need throughout the process.
