The worst thing a person facing foreclosure can do is nothing. Simply answering the complaint will afford the borrower precious time to examine the merits of the Plaintiff's case, and pursue other avenues outside of judgment to resolve the case. Time is of the essence, and a foreclosure attorney can help a client make the most of it.
Bankruptcy is a Constitutional protection from the claims of creditors for individuals who are unable to free themselves of crippling debt. All collection activities must stop once the bankruptcy petition is filed, including foreclosure actions. Though credit scores are severely impacted, bankruptcy is a path to a fresh financial start and renewed peace of mind.
There are millions of Americans who are behind on their bills, and the collections calls and letters clog telephone lines and mailboxes across the country. Because debts are routinely bought and sold, however, often the party suing to enforce the debt has difficulty proving it owns the debt. If ownership cannot be legally shown to exist, then many cases are dismissed as a result. Furthermore, cracks in a Plaintiff's case lead to more generous settlement offers to defendants.
