You really need to consult an immigration lawyer and a divorce lawyer
If I signed a non prosecution statement can I go back and ask that the person be prosecuted years later?

Not likely. Once they drop the case, it's dropped even if you change your mind if your signed the dismissal.

I'm afraid it's not that easy. You have to take them to court and get a judgement against them first.
