In a Nevada Legal Malpractice case brought in Las Vegas-Clark County, Nevada, 450-pound client suffered soft tissue injuries in a Nevada slip & fall on the property of a governmental entity. It was a ... lleged the Plaintiff suffered from medical malpractice when he had lowered consciousness at the Nevada rehabilitative hospital. As to the slip and fall, there is a Nevada governmental entity damage cap and persuasive arguments for reducing damages. Attorney Selik was able to obtain a substantial confidential settlement against the attorney. The out-of-state worker’s compensation insurer claimed subrogation, and when the insurer would not negotiate, Attorney Selik found case law in insurer’s state that precluded any worker’s compensation subrogation in legal malpractice cases. This allowed the case to settle faster and at a much higher amount.
