Law school taught me how to resolve disputes using the adversarial judicial system, but provided no guidance on resolving disputes through effective communication and negotiation.
In the late 1980’s mediation came into the spotlight as an alternative to litigation and as a way to help clear a crowded court docket. I saw mediation as a way to utilize the skills I developed in undergraduate school as a speech communications major. In the last few years the legal profession has finally embraced the value of skilled communication professionals who have studied and mastered the art and science of interpersonal and group communications. My expertise in interpersonal communications involving conflict, problem solving, decision making, and facilitation of large and small groups is a skill possessed by only a few mediators.
Lawyers and judges trained in the adversarial system and the art of persuasion, skills necessary in the court room, sometimes lose sight of the human component, the soft skills necessary for effective problem solving and decision making that lead to durable long term solutions.
I strive to conduct my business and live my life on the values of integrity and respect.
My promise to you is to:
1. Treat others as I would like to be treated.
2. Listen with the intent to understand what is being said and acknowledge that what is said is important to the speaker.
3. Respond in a timely fashion.
4. Speak calmly and respectfully, without profanity or sarcasm.
5. Acknowledge everyone is right from their own perspective.
6. Make only agreements I am willing, able and intend to keep.
7. Communicate all potential issues at the first appropriate opportunity to all parties.
8. Look to the system for correction and propose all possible solutions if something is not working.
9. Operate in a responsible manner always taking the high road.
10. Communicate honestly and with purpose.
11. Ask clarifying questions if I disagree or do not understand.
12. Never say anything to anyone that I would not say to him or her.
13. Make our best effort to understand and appreciate the customers’ needs in every situation.
