Yes they can charge you that way, depending on what they are alleging. Hire a good lawyer to keep you from a long jail term.
Can a charge be nolle prossed and refiled twice?

Yes it can be done twice. No they don't have to serve you with the summons. They can wait until you come to court on the dui to do it.
