Ms. Smith drafted a will and living trust for me in 2015. It was a bad experience, and the I believed the document needed to be re-written from the moment I received it as it did not reflect my wishes. The attorney insisted on writing in a clause requiring my heir to use a 3rd party administrator - w...ho her firm could supply - when I did not want this to be done. We went through multiple drafts before I was able to get her to remove it. The document also includes a "Special Needs Trust" within the main trust and a requirement that someone make repeated visits to my heir as a condition of distributing the money. I did not want either of these, and really just wanted to leave money to an heir, as it was arranged in the original trust document. As a result, I have a difficult, bloated document that does not reflect what I want to do and will be very difficult on my heirs if I were to pass. But it was required to pay a sum in advance and by the time I had this experience I was out the money - and it was not an insignificant amount. So I decided to cut my losses, finish the document and just revise it as soon as any little change in my situation warranted it. So why the review now? Well, my situation has changed. I wish to add an asset to the trust, then re-write it with a different attorney. I called the office with a simple request to confirm that I was naming the trust correctly in the asset title, because I can find no record of receiving instructions for funding the trust. The office refused to do even this simple confirmation. I find that wrong. I find many things about this experience just wrong. I feel I was represented and treated poorly.
