About Scott

Learn Scott’s areas of practice.

Practice areas
  1. Elder law
Our firm, one of the first Elder Law firms in Florida, focuses its practice exclusively on the legal needs of the elderly, people with disabilities, their caregivers and their families.

    30 years, 8,000 cases

  2. Medicaid and medicare
Medicare does not cover long-term care. Medicaid is the largest payor of long-term care in the United States but can only be accessed if the applicants are below the government's established limits. We help people to protect their assets.

  3. Estate planning
Through the use of Wills and Trusts, we assist our clients with planning for what happens with assets after death BUT we first focus on the lifetime needs of her clients by planning for incapacity.

  4. Guardianship
When a person can no longer care for themselves and are at danger, the courts sometimes appoint guardians. We assist people with this complicated and often frustrating process which is rife with ethical and legal issues.

  5. Power of attorney
A power of attorney is a document where a client picks another person who can step in and "do for you if you cannot do for yourself." This document can be specifically tailored to a client's needs. There is no one-size-fits-all form.

  6. Probate
After a person's death, probate, a court process, is sometimes necessary. The firm assists executors, personal representatives and trustees to administer estates. For our estate planning clients, we present ways to avoid probate.

Scott's Story

I went to law school to help people but then got caught up in the competition to get the most prestigous position when I graduated.  Having graduated with honors, I took a high-paying job with a highly regarded law firm but quickly realized that corporate securities law was not for me.  I represented large corporations and had only one human client the entire time I was with that firm. I wanted the satisfaction of helping people.

Fortunately for me, I had an option most lawyers do not.  My father was one of the founders of the field of Elder Law. He wrote the first book on the subject for lawyers, co-founded the state and national Elder Law organizations and was looked upon as a pioneer and a very fine lawyer.  During a trip to visit my parents, I sat in with my father as he met with family after family.  I saw how much of an impact he was able to make on his clients' quality of life and peace of mind.  It took my breath away.   I quit my job, took a big pay cut and moved from a luxurious office tower to my Dad's very modest office in Deerfield Beach.  Together with some of his colleagues, he trained me and I became very involved in the field.

I felt I had to work harder than most so that I could make my own reputation and move out from under my father's very large reputation.  I also wanted to make my father proud.  I opened up my own law practice in 1999 in Palm Beach County.  Before my father's death in 2016, he was able to see me build my own successful law firm.  In 2004, I was elected Chair of The Florida Bar's Elder Law Section, representing the interests of 1600 Elder Law Attorneys and their clients.  I sat on the Board of Directors of the National Academy of Elder Law Attorneys.  I became a Board Certified Specialist, one of only two percent of attorneys in Florida at the time.  I became one of the youngest attorneys in the country to be elected a Fellow of the prestigious American College of Trust and Estate Counsel.  After my father's retirement in 2011, I took over the writing of his textbook on Elder Law and it is now the bestselling book in its category, over 1000 pages long, and is in its 17th print edition.  I achieved the A/V "Preeminent" rating by Martindale Hubbell.  I was awarded the Charlotte Brayer Public Service Award for Elder Law and the John Regan National Writing Award in 2015.

More than any of these activities or accollades, the most important thing to me is my family (I have four world-changing children and a superstar wife) and the fact that I absolutely love my job.  With so much to be grateful for, I have taught hundreds of lawyers how to practice elder law.  I lecture regularly across the country for the American Bar Association, the National Academy of Elder Law Attorneys, The Florida Bar and other groups.  I am the lead instructor for Elder Law College where lawyers transition from other practice areas to become Elder Law Attorneys.  My greatest professional satisfaction still exists in my client meetings.  I get to help real people every day with the most core human issues -- how can I preserve my life savings?  how can I get more care for my loved one?  how do I plan for my own incapacity?  I often get a check and a hug.  Good stuff.

Best Lawyer I ever met!
Mr. Solkoff represented me and my parents. He was able to protect their savings which were being spent at an astounding rate first for home health aides and then for my Dad's nursing home care. We paid one fee and he represented us for over three years. Never charged another penny and even suggested other documents and did not charge extra. I think we got to know the whole office because they all work together. Mr. Solkoff was recommended by my attorney in New York and then two other lawyers in Florida. I have learned in life that if you need surgery, find out who the other surgeons would go to for their family. Same with lawyers. I am a businessman. I work with lawyers a lot. This was by far the best experience I have had. Worth every penny. He literally wrote the book. This guy is the real deal and humble too. He was so patient with my mother.

Rave Reviews!!
Awesome business! I first met with Scott and he was very cordial and helpful, then most of my dealings were with Brandon and Madeline. I kind of expect the best and they sure delivered. Brandon responds within approx. 24 hours and Madeline, his assistant, responds within minutes. I have recently been in a situation having to hire an Elder Law attorney in Ohio for a relative. Absolutely no comparison. The Ohio firm is tough to get a hold of and usually don't have my answers. I cringe when I have to call Ohio. Definitely recommend Solkoff Law and will use them again when the need arises.

Superb, professional and personable-the whole package
From start to finish my husband and I were explained everything in detail setting up our trust and at closing we telephone conference our son in Gainesville while our daughter was with us in person. It makes us feel very secure now that our will/trust is set up and our children heard everything first hand. Don't go anywhere else, this firm is very personable-the entire staff and professional in the same breath.

It was a great comfort knowing that my mom was protected, and she would be able to age gracefully, either in place or at a nursing home. Solkoff legal has been there from the beginning, and everything has worked out perfectly and as expected. The peace of mind is really worth it!

A great firm
I have used Solkoff Legal to set up all my legal documents in order to prepare for our needs in later life. I found Scott and all his associates to be knowledgeable and fully aware of my requirements. When a situation arose that caused us to use some of the documents (Power of Attorney, Health Care Surrogate) he suggested I knew that I was completely covered. I know my future is secure because I used this firm.

Top elder law attorney
Both personally and professionally, I have utilized Solkoff Law for over 10 years. Personally, he has helped my dad before he passed at 101. His expertise and knowledge helped dad pass in a beautiful assisted living facility because of his work in family asset protection. He has prepare custom documents for me and my wife who is disabled. Professionally, he has helped dozens of my clients in long term care planning and for caring for a child of special needs. I have shared the podium with Scott and have been in meetings with his clients and mine. He is one of the most skilled attorneys that I have ever worked with in 30 years of wealth management practice. His staff is first rate and always responsive to my calls or those of clients. I have gone on end of life hospital visits with him to complete planning to help the family when their loved one is about to pass. Solkoff Legal is first class, knowledgeable, caring and accessible They are the team you want on your side with your planning and problems..

Lives up to the reputation
We were referred to Mr. Solkoff by two separate sources, my brother's attorney in New York and my mother's neurologist in Florida. Both said that Mr. Solkoff was not only one of the top Elder Law Attorneys in the country but a nice and caring man. We were super pleased. Mr. Solkoff related complex legal concepts in bite-size drawings and explanations. He made us face some difficult issues we had been avoiding and I cannot tell you how much peace of mind we now have. He has other attorneys who work for him and they help also. Mr. Solkoff spent at least three hours with us at the first meeting because we had a lot of questions and were having a major problem that requires immediate fixing. Mr. Solkoff and another lawyer working for him were responsive (I always got calls back within the day), professional, knowledgeable (he has a copy of his book on the table when we meet), and it is clear that he cares. The only negative is the fee and the wait. It took us over a month to get an appointment, though we did get in earlier when a spot opened up in his calendar earlier. The fee was higher than we expected but I now see that we have saved many times that amount and good service and advice, in our case, was well worth it. I also want to say that mr. Solkoff was GREAT with my mother who can be very difficult. Great bedside manner.
