Allen R. Tomlinson

Allen Tomlinson is a Florida Bar Certified Business Litigation Attorney who represents clients in commercial loan workouts, foreclosures, lender liability claims, and contested bankruptcy proceedings, as well as construction, real estate and other complex business litigation. He is the 2010 recipient of the Legal Aid Society's Civil Litigation Award.

Mr. Tomlinson is listed in Corporate Counsel Super Lawyers and as a Florida Super Lawyer by Law & Politics Super Lawyers Magazine.  He has lectured on secured transactions, bankruptcy, construction liens, construction litigation, lender liability and real estate litigation issues for programs sponsored by the National Business Institute, The Florida Bar and the Palm Beach County Bar Association.

PRACTICE HIGHLIGHTS:

• Successfully represented a national bank in a multimillion dollar contested commercial foreclosure action that included the defense of a lender liability and punitive damage counterclaim in excess of $10 million submitted to a jury, as well as the related bankruptcy proceedings.
• When an institutional construction lender faced multiple borrower defaults and lender liability and construction lien claims resulting from the failure of a prominent builder, Allen negotiated resolutions with the borrowers and lien claimants through which the houses were finished, and the construction lien and lender liability claims were resolved with minimal litigation.
• Represented a large country club community in negotiating with a national construction company for a contract for a multi-million dollar improvement of the clubhouse facilities .
• Teamed with Steve Rothman in successfully defending an office building owner in a jury trial against a multimillion claim by a party claiming permanent disability from alleged toxic mold exposure.
