Client was brought to the United States by his parents as a very young child. He has lived here his entire life and graduated from high school with good grades. He is a very hardworking and responsib ... le young man that aspires to go to college and become a nurse. However, when his parents brought him to the U.S., they did so without going through any of the formalities of establishing legal immigration status -- they just drove across the border. So Client has reached adulthood with no legal status. Since he does not have legal status (for example "US Citizen" or "legal permanent resident") he could not get a driver's license or work authorization, which is why he looked for legal assistance. I helped Client apply for a form of relief that was established just last year, called "deferred action for childhood arrivals" or DACA, for short. This form of relief is for individuals who came to or were brought to the U.S. before they reached the age of 16, with no legal status. (There are additional requirements.) If an individual applies for and is granted DACA, the result is that they can breath easy for the next two years (and then DACA can be renewed) without fear of being deported simply because they are not citizens or legal permanent residents. They can also get work authorization.
OUTCOME: Successful defense - no DV restraining order issued
Client was falsely accused of domestic violence by an angry spouse who didn't like that Client filed for divorce. Angry spouse was attempting to smear Client's reputation and gain advantage for child ... custody arguments during their divorce proceedings. Defended Client and convinced the court that the spouse's claims were not to be believed! Saved this Client from getting an unjustified DV record.
OUTCOME: Removal order dismissed
US Citizen Husband married non-citizen Wife. Husband and Wife follow the law and complete family based immigration paperwork. Wife legally immigrates to the US and is granted a green card. However, H ... usband and Wife did not understand that it is only a temporary green card and that an application to remove conditions must be filed by a certain deadline. They miss the deadline and had moved from the address they lived at when they filed Wife's original immigration paperwork. Without the couple even knowing about it, immigration had sent a "Notice to Appear" to their old address telling them that wife must appear in immigration court for a removal hearing. Obviously they didn't show up in court - since they never received notice of the hearing - and a removal order was issued against Wife. Several months later, after ICE apparently tracked down the couple's new address, the couple finally learns about the removal order when armed ICE agents show up at Husband/Wife's home to take her into custody. I successfully defended Wife from removal and got the removal order dismissed. This otherwise law abiding, hard working, tax paying couple, whose only mistake was missing paperwork deadlines, can now move on with their lives!

Client had a challenging case - while Client met the physical presence requirements, because Client had graduated from high school a couple years prior to applying for DACA, Client was in a difficult p ... osition to document Client's continued physical presence -- one of the requirements a DACA applicant must provide evidence of. I came up with some creative suggestions for how to document Client's continuous physical presence in the US in the years after Client graduated from high school (but during which Client had no SSN, no driver's license, no credit cards, no continued school attendance records, no paystubs/work records since w/o a SSN client couldn't officially work... really no reliable/trackable evidence), so we were able to evidence Client's continuous / uninterrupted physical presence and DACA was granted!
