OUTCOME: Case was dismissed
Client had been at the Casino for a couple of hours. He was not under the influence, but he does have significant sight deficiencies which are aggravated at night. He stated that he had only one (1) ... drink at the beginning of the night because he was the designated driver. The passengers were all under the influence, but they had planned to have my client drive, so they were not concerned. My client was stopped by security, which started an argument because the group was ready to leave. The security guard called the police. Although he was not required to wait for the police, my client stayed to discuss the events with law enforcement. As soon as the officers arrived, the security guard pulled the lead officer aside and had a long conversation. It was clear from the manner in which they engaged that they knew each other. The officer approached my client in a very disrespectful manner, which added fuel to an already tense situation. My client was immediately accused of being under the influence, although he was clearly not under the influence. The officer used my client's red eyes, and his heavy Eastern-European accent as evidence of intoxication. We filed a motion to suppress, which was granted. The State was forced to Nolle Prosequi (dismiss) the case.
OUTCOME: Not liable
A man had been arrested for a crime for which he was later convicted. He was serving a significant prison sentence. As part of the Volunteer Lawyers Project the case was assigned to me and we conduct ... ed the trial. The allegations were that a group of law enforcement officers beat the client causing injuries. The case was tried twice. The first trial ended in a mistrial. The second time the jury determined that the evidence did not meet the burden required by law.
OUTCOME: Dismissed
Case dismissed. No publicity!
OUTCOME: NOT GUILTY
This case was complex because it dealt with fingerprint evidence, DNA evidence, ballistics and the experts that handle such evidence. The Defense had to attack the manner in which the evidence was coll ... ected and conclusions made by the State of Florida. In the end, we had to retain the services of a former FBI fingerprint analyst, who assisted with the defense. We were able to prove that the Detectives had determined from the start that the client was the perpetrator and then attempted to make the evidence fit that narrative. We were able to successfully attack the ballistic evidence, DNA evidence and more importantly the fingerprint evidence. The jury came back with a Not Guilty Verdict
