Jonathan Marc Midwall

Jonathan Midwall was listed as defense counsel for LA Fitness in my civil case and was consistently copied on filings, court orders, and correspondence throughout the critical period after my attorneys withdrew. Although he was not the primary attorney communicating with me, his inclusion on the reco...rd meant he was fully aware of the procedural posture of the case and the serious defects in service and notice that were occurring. Despite being on notice that I was being treated as properly served using an email address I never designated or registered with the court, and despite certified mail being sent to an incorrect address and returned, Mr. Midwall did nothing to correct the record or alert the court. The defense continued to proceed as if service were valid, even after I provided proof that the court’s reliance on email service was improper and unsupported by the case management system. By remaining silent while the record reflected service that I had never consented to and while returned mail was ignored, Mr. Midwall participated in allowing a fundamentally defective procedural record to stand. His failure to intervene or correct known inaccuracies contributed directly to my case being dismissed without a meaningful opportunity to be heard. As counsel of record, Mr. Midwall had a professional obligation to ensure the accuracy of representations made to the court once aware of defects. In my experience, he chose not to act. I would not recommend Jonathan Midwall to anyone who expects opposing counsel to respect procedural integrity, fairness, or the basic obligation to correct the record when it is known to be wrong.
